These Terms of Service ("Terms") govern your access to and use of Pass and Run (the "Game"), operated by the Pass and Run development team ("we", "us", or "our"). By creating an account or using the Game you agree to these Terms. If you do not agree, do not use the Game.
1. Eligibility
You must be at least 13 years old to use Pass and Run. By creating an account you confirm that you meet this age requirement. If you are between 13 and 18 years old, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@passnrun.com if you believe your account has been compromised.
One account per person. Creating multiple accounts to gain a competitive advantage is prohibited.
3. Virtual Currency
Pass and Run uses two in-game currencies:
- Credits (soft currency) — earned through gameplay. Cannot be purchased with real money.
- Coins (hard currency) — purchased via Apple In-App Purchase or Google Play Billing.
Virtual currencies have no real-world monetary value and cannot be transferred, sold, or redeemed for cash or any other real-world goods or services outside the Game. All purchases of Coins are non-refundable, except where required by applicable law (including consumer protection laws in your jurisdiction).
We reserve the right to modify the pricing, availability, or in-game use of virtual currencies at any time. We are not liable for the loss of virtual currency due to account termination resulting from a breach of these Terms.
4. Prohibited Conduct
You agree not to:
- Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorised third-party software to interact with the Game.
- Share, sell, or transfer your account to another person.
- Attempt to reverse-engineer, decompile, or tamper with the Game's server-side logic or match engine.
- Harass, abuse, or threaten other players.
- Upload or transmit any content that is illegal, harmful, or infringes third-party intellectual property rights.
- Attempt to gain unauthorised access to our systems or other users' accounts.
Violation of these rules may result in suspension or permanent termination of your account without notice or refund.
5. Service Availability
Pass and Run is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free access to the Game. During the MVP phase we offer no uptime SLA. We may take the Game offline for maintenance, updates, or security fixes at any time, with or without prior notice.
We reserve the right to modify, suspend, or discontinue any feature of the Game at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance.
6. Intellectual Property
All content in the Game — including player names, club identities, artwork, code, match engine logic, and copy — is owned by us or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to use the Game for personal, non-commercial purposes. Nothing in these Terms grants you ownership of any Game content.
7. Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be secure, free of viruses, or meet your requirements.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Game, including loss of virtual currency, data, or profits — even if we have been advised of the possibility of such damages.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict-of-law provisions. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, unless mandatory consumer protection law in your jurisdiction requires otherwise.
10. Changes to These Terms
We may revise these Terms at any time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Game after the effective date constitutes acceptance of the revised Terms.
